The difference between social eating e home restaurant

Gnammo is actively engaged in defining, along with the national bodies in charge and the trade associations, the borderline between social eating and home restaurant, both related to the sharing economy phenomenon.
Today this border is not marked by a certain norm but there is a quantitative parameter which, in the context of social eating, gives an indication to private users: it is the total amount of transactions in the calendar year which, if it exceeds €5,000 , requires the Cook to pay social security contributions. Gnammo is gearing up to add an automatism that will carry out this operation for the Cooks who will find themselves in these conditions.
More than this reason, we believe that between social eating and home restaurant there is a strong difference in connotation: the social eating strongest purpose is the socialization between people, the possibility to share passions and carefree moments in one's own home; for home restaurant, instead, the economic aspect and continuity can have greater weight.

The social eating for Gnammo Cooks

If you occasionally carry out private events, without the aid of professional equipment or a company-type organization (presence of waiters, multiple tables set, printed menu, etc.) you're organizing social eating events.

We think that for social eating the peculiarity, as well as the ultimate purpose of the event itself, is the desire to socialize and share a passion; the economic contribution has the sole purpose of returning costs.
For social eating events, from a regulatory point of view, there are no requirements.
Despite of that, Gnammo and the whole community expect that the normal hygienic rules that we think you are used to observe for yourself, are respected. We are therefore sure that you will be careful to welcome your Gnammers in a clean and comfortable environment.

Home restaurant and requirements

If you organize events regularly, with collaborators and professional tools that allow you to structure a profitable project, then you probably do home restaurant activities.
In this case you will have to follow the requirements of the legislation: at the presentation of the SCIA (or at the request) you will have to document that you have verified the HACCP self-control manual.
To get the necessary requirements for a home restaurant activity we advise you to refer to the competent authority of your municipality of residence.

TAX LEGISLATION

From a fiscal point of view, a social eating event is an occasional service provision between individuals. This requires the cook to issue a tax receipt to the Gnammer, but Gnammo does it for you!
If you are a Cook you will have to hand over all the documentation relating to your activity on Gnammo to your tax advisor at the end of the year (including receipts for shopping and Gnammo receipts): he will do the accounts and enter the correct figures in your tax return among those arising from occasional activity.
If you generate a transaction volume close to € 5,000 in a year, Gnammo will report it to you and will give you instructions on what is required.
